AVC patentees file suit against ZTE and Huawei

Cohausz & Florack representing the plaintiffs before Düsseldorf District Court

Düsseldorf, 16 February 2017 – Several AVC patentees whose patents are licensed via a patent pool by the US company MPEG LA, have filed a suit for patent infringement against Huawei Technologies Deutschland GmbH (Huawei) and ZTE Deutschland GmbH (ZTE). The subject of the legal action is the digital video coding standard AVC/H.264 (MPEG-4 Part 10), which is used in mobile devices and other products.

According to the charges, Huawei and ZTE provide mobile phones with AVC technology in Germany, without having purchased licenses from the patentees or MPEG LA. Claims for damages and injunctive relief are now being asserted through the suits.

German patent infringement proceedings have already played a central role in the enforcement of patents from patent pools offered by MPEG LA. “The suits now filed are an important step with which to ensure fair remuneration for the companies involved in the development of the AVC technology”, explains patent attorney Gottfried Schüll of Cohausz & Florack. The plaintiffs are being represented at Düsseldorf District Court by Cohausz & Florack together with attorney Axel Verhauwen of the law firm Krieger Mes Graf v. der Groeben.
