Effective and affordable: opposition proceedings
One way of taking action against restrictions imposed by a competitor is by bringing opposition proceedings. The advantages:
- Opposition proceedings can be filed within the first nine months after publication of the mention of the grant of the patent.
- They are much less expensive than revocation proceedings.
- Opposition proceedings are the method of choice for a European patent in particular, as nullity proceedings do not have to be conducted in individual European countries.
