Effective and affordable: opposition proceedings

One way of taking action against restrictions imposed by a competitor is by bringing opposition proceedings. The advantages: 

  • Opposition proceedings can be filed within the first nine months after publication of the mention of the grant of the patent.
  • They are much less expensive than revocation proceedings.
  • Opposition proceedings are the method of choice for a European patent in particular, as nullity proceedings do not have to be conducted in individual European countries.

The chemicals and life sciences sectors are fiercely competitive, also given the competition from generics companies. As originators, many of our clients have invested large sums of money in the research and development of their products and have a legitimate interest in selling them exclusively for the entire term of the patent.
