Düsseldorf, April 11, 2025 – Cohausz & Florack (C&F) has won the title “Germany Impact Case of the Year” at this year’s Managing IP Awards. The case in question, in which the C&F team played a prominent role, led to the Federal Court of Justice (Bundesgerichtshof – BGH) landmark decision X ZR 104/22 (May 7, 2024), which held that claims for damages due to patent infringement must also be considered if a contract was performed in a patent-free country. Together with the law firms Heuking and Budde Schou (Denmark), C&F represented a Danish plant manufacturer, which – as the licensee – had filed a lawsuit against a German competitor. C&F’s patent attorneys and partners Andreas Thielmann and Jan Ackermann played a pivotal role in the case.
