Dr. Arwed Burrichter, Dr. Natalie Kirchhofer and Dr. Tobais Hoheisel will update you on some of the most relevant EPO Board of Appeal decisions and Enlarged Board of Appeal referrals that are likely to impact the prosecution, opposition and enforcement strategies for patents in the chemistry, pharma and the life sciences space going forward.

Topics to be discussed include:

• TBA case law applying Enlarged Board of Appeal decisions 
  • G1/24 “Heated aerosol” on using the description to interpret the claims, and
  • G 1/23 “Solar cell” on commercially available (but not necessarily reproducible) compositions as prior art.
• Key TBA decisions covering both procedural as well as substantive issues, including second medical use claims, priority entitlement, sufficiency of disclosure, added matter, novelty, and inventive step.
• Tips on strategic aspects based on recent EPO opposition and appeal cases
