CFTalks - Patent (In)Validity at the EPO and in Germany

Expert Strategies, Best Practices and Lessons Learned

With over 750 Opposition and Appeals and about 150 national German patent nullity proceedings (including over 30 patent nullity appeal proceedings before Germany‘s Federal Court of Justice) that COHAUSZ & FLORACK conducted in the last five years, patent (in)validity at the EPO and in Germany is one of our core competencies. In this CFTalks event we will provide you with the groundwork for a better understanding of these proceedings, starting with an introductory talk on EPO Opposition and Appeal proceedings as well as German patent nullity proceedings. Next, experienced practitioners with special expertise in these proceedings will present their insights, lessons learned and best practices, both for the first instance, but especially also for the appeal proceedings. Case studies from three important technical fields, Mechanical Engineering/ MedTech, Electrical Engineering/ IT and Chemistry/Pharma/Life Sciences, will serve as illustrations.

We are particularly pleased that patent luminary Dr. Ursula Kinkeldey agreed to speak at this event based on her vast experience as former madam chairman of an EPO Technical Board of Appeal and permanent member of the EPO Enlarged Board of Appeal. In her presentation, she will provide tips and tricks s well as do’s and don’ts or EPO opposition and appeal proceedings. She will also comment on how the planned changes to tighten up the Rules of Procedures can be expected to impact on EPO opposition and appeal proceedings and present associated strategic considerations.
